1. 피고인들의 공동범행 피고인들은 2014. 12. 25. 21:00경 구미시 C에 있는 피해자 D 운영의 ‘E’이라는 상호의 식당에서 술을 마시던 중, 피해자로부터 “가게 안에서는 담배를 꺼달라”라는 말을 듣자, 피고인 A는 피해자에게 “씹할 놈아, 야이 새끼야!”라고 욕설을 하며 주먹을 쥔 채로 피해자의 얼굴을 폭행할 것처럼 위협하고, 피고인 B은 피해자에게 “씹할 놈아, 장사하기 싫으냐 ”라고 욕설을 하며 그곳에 있던 의자를 들어 피해자에게 던지려는 태세를 보이며 그곳에 있던 손님들에게도 “야이 씹할 놈들아!”라고 욕설을 하는 등 소란을 피워 손님들을 밖으로 나가게 하는 등 위력으로써 약 10분 동안 피해자의 식당운영 업무를 방해하였다.
