1. The defendant shall be the plaintiff.
(a) KRW 23,925,000, as well as 5% per annum from April 1, 2015 to November 5, 2015;
Reasons
1. Basic facts
A. On April 30, 1998, the Plaintiff completed the registration of ownership transfer in its name with respect to the 646 square meters of forest B, C forest land 431 square meters, D forest land 797 square meters, and completed the registration of ownership transfer on August 22, 1997 with respect to the E-10 square meters of forest land.
(hereinafter referred to as "each of the above land" is individually named, the parcel number shall be specified, and when the whole is referred to as "each of the above land", the parcel number shall be specified.
The entire or part of each of the instant lands was used as a toll for the general public from around 2009. However, around March 201, the Defendant requested the Plaintiff to prepare a written consent on the package of the road for the purpose of maintaining the current road. On March 2011, the Plaintiff prepared and issued a written consent to the Defendant’s consent on the part of the area to be actually incorporated into the road among the instant land.
C. Around May 4, 2011, the Defendant: (a) performed road packaging construction works on part of the instant land, namely, 358 square meters among the instant land; (b) 253 square meters among the forest land B; (c) 546 square meters among the D forest land; and (d) 83 square meters among the E forest land.
After that, on December 5, 2012, the Defendant determined an urban management plan with respect to the permissible urban planning facilities (a balance sheet) of the Filwon in the Suwon-si District pursuant to the provisions of Article 30 of the National Land Planning and Utilization Act, and announced it as a H of the public announcement at the time of tolerance. Of each of the instant land, the land B-57 square meters of forest land and 755 square meters of D forest were incorporated as a road site according to each of the instant urban planning decisions.
E. If the area on the register of each land of this case and the area included in the road packing area or urban planning facility are adjusted, it is as listed below:
