Reasons
Basic Facts
The owner of the Dong-gu Seoul Special Metropolitan City G-gu 916С (hereinafter “instant land”) and the 36.36 square meters of detached houses of 1st floor (hereinafter “the instant building”) and H large 96 square meters (hereinafter “the instant land No. 2”); hereinafter “the instant land No. 1” and “the instant land No. 2,” collectively referred to as “the instant land”) were placed in the state of disappearance before and after around 1955, and around July 10, 1955 through the adjudication of disappearance around 1968.
With respect to the land of this case No. 1, as of October 22, 1971, the Busan District Court received a registry office of the Jungsan District Court on the ground of the inheritance of the property on March 12, 1968, under Article 26535, the registration of ownership transfer was completed in the name of the deceased J, K, L, L, M, and the Plaintiff, and the registration of ownership transfer was completed on the ground that the deceased J, under Article 26540 of the receipt of the registry office of the Ulsan District Court on the same day, was completed on September 11, 1971 by the deceased J, who is a co-owner of other co-owned shares, from K, K, L, M, and the Plaintiff.
N on October 5, 1976, purchased 40/277 shares of the land of this case from the deceased J on February 2, 1977 and completed the registration of partial transfer of ownership on February 2, 1977. Defendant B and E completed the registration of partial transfer of ownership on May 3, 2006 as to each share of 118.5/27 out of the land of this case on April 27, 2006.
With respect to the land of this case No. 2, on October 22, 1971, the inheritance registration was completed on the ground of inheritance on March 12, 1968, and on the same day, the registration of ownership transfer was completed on the ground that the deceased J purchased all shares from other co-inheritors on September 11, 1971 as the receipt of the Busan District Court Branch Registry No. 26540.
As to the land No. 2 of this case, Defendant B completed the registration of ownership transfer on the ground of the agreement on division of the inherited property as of June 22, 2010 by the receipt of the same registry office of the Ulsan District Court (No. 4653) and January 12, 2010.
Defendant B and F are children between the network J and the network C, and Defendant E is the defendant.
