A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. The defendant is a person who violated the Punishment of Violences, etc. Act (Habitual Assault) and was sentenced to a suspended sentence of 1 year and 6 months in the Seoul Central District Prosecutors' Office on July 23, 2001 to imprisonment with prison labor and 1 year and 3 years in the Seoul East District Court on January 30, 2003 to the juvenile department due to the crime of aggression at the same prosecutors' office on January 30, 2003, and was sentenced to a suspended sentence of 1 year and 3 years in the Seoul East District Court.
On May 16, 2012, at around 21:10, the Defendant: (a) accessed the Eststyna taxi car driven by the victim D (the age of 56) in front of Gangseo-gu Seoul Metropolitan Government; (b) faced the Defendant’s arms with the victim’s car; and (c) made the victim walked with the victim’s car; and (d) pretended that the victim was faced with a traffic accident, and (c) made the victim “I am away from the vehicle. I am flick, I am flick. I am flick, I am flick. I am flick, by reporting it to the police at the bar, I am flick. I am flick, I am to take measures to have the victim be subject to criminal disadvantage without the Defendant’s request; and (c) received KRW 700,000 from the victim on May 17, 2012.
In addition, from October 5, 2010 to August 15, 2012, the Defendant received property amounting to KRW 9,460,000 from the victims in total on 38 occasions, such as the entry in Appendix I, and received property habitually and habitually, by the following methods:

A. On May 16, 2012, around 21:14, the Defendant reported 112 false information about D in front of the Gangseo-gu Seoul Metropolitan Government F.
The contents of the above 112 Declaration were "the accident was caused by the fire protection area."
D On May 16, 2012, at around 21:10, 2010, a car driving in front of Gangseo-gu Seoul Metropolitan Government is going away without any measure after having caused an accident that gets a pedestrian while driving a car in front of Gangseo-gu Seoul Metropolitan Government.
