A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2018. 12. 3. 22:10경 대전 중구 B, 피고인이 살고 있는 C 원룸 앞 노상에서 술에 취하여 앉아 있던 피해자 D(가명, 여, 43세)을 발견하고 피고인의 방으로 데려가 간음하기로 마음먹고, 술에 만취된 피해자에게 다가가 말을 건 다음 피해자를 부축하여 위 원룸 E호에 있는 피고인의 집으로 데리고 들어간 후 피해자를 그 곳 침대 위에 눕히고 피해자의 몸 위에 올라 타 피해자의 스타킹과 팬티를 벗기려는 과정에서 피해자가 손으로 밀어내고 발로 찼으나 술에 취해 힘이 없어 제대로 된 항거를 하지 못하였고 이에 피고인은 억지로 피해자의 스타킹과 팬티를 벗긴 다음 피해자를 1회 간음하였다.
