1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Basic Facts

On October 9, 2009, the Plaintiff and the United Nations Global Co., Ltd. (hereinafter referred to as the “CN Global”) obtained project approval for the construction work of the Kudong-gu Sikdong-gu Si Sikdong-gu Kukdong-gu Seoul Special Metropolitan City Housing (hereinafter referred to as “the construction work of the instant construction work”).

On December 16, 2009, the Plaintiff was selected as a supervisor of the instant construction project from the Pakistan-si. On December 23, 2009, the Plaintiff concluded a supervision agreement with regard to the UN Global and the instant construction project as between 33 months from June 1, 2010 and 2,026,281,703 (excluding value-added tax).

On June 1, 2010, the Plaintiff entered into a contract to amend the term of the supervision agreement to 28 months from June 1, 2010 to September 30, 2012. On March 31, 2011, the Plaintiff finally concluded a contract to amend the term of the supervision agreement from June 1, 2010, to November 30, 2012 (excluding value-added tax) with the contract amount 2,210,203,524 (hereinafter “instant supervision agreement”).

The United Nations Global has paid the service cost to the Plaintiff by June 19, 2012 under the instant supervision agreement, but did not pay the 10 and 11th service cost.

The Korea Asset Trust Co., Ltd. (hereinafter referred to as the “Korea Asset Trust”) that succeeds to the instant supervision agreement is the project undertaker of the instant construction.
