피고인은 2014. 7. 13. 02:10경 안산시 상록구 C에 있는 'D편의점' 앞 노상에서 '시비가 있다.'는 112신고를 받고 출동한 E파출소 소속 피해자 경사 F에게 술에 취하여 아무런 이유 없이 "야 씹할놈들아, 짭새 새끼들아"고 욕을 하여 성명불상의 편의점 종업원과 손님들이 보는 가운데 공연히 피해자를 모욕 하였다.
