1. The defendant shall pay to the plaintiff 56,624,040 won with 12% per annum from August 25, 2020 to the day of complete payment.

The facts without dispute, Gap evidence Nos. 1 through 8, and the purport of the entire pleadings are as follows: ① on April 3, 2018, the plaintiff changed the area of mechanical equipment construction from C Hospital Construction to December 15, 2019; ② on April 6, 2019 to November 30, 2019; ② on April 4, 2018, the owner of the construction; ② on November 26, 2019, the plaintiff et al. agreed to pay the subcontract price directly by the ordering person; ③ on November 26, 2019, the plaintiff changed the date of completion to 2.19 million won; ④ on April 24, 200, the construction price was reduced to 2.19,67 million won; ④ on April 24, 201, the plaintiff paid the subcontract price to the defendant through the completion inspection by the other ordering person; ⑤ on April 26, 2016.

Therefore, the Defendant is obligated to pay the Plaintiff the construction cost of KRW 56,624,040 as to the portion of the subcontracted construction cost that was not paid to the Plaintiff, and the damages for delay calculated at the rate of 12% per annum from August 25, 2020 to the date of complete payment, which is the day following the delivery date of a copy of the complaint of this case as sought by the Plaintiff.
