1. The Defendant paid KRW 39,494,09 to the Plaintiff KRW 5% per annum from April 12, 2014 to July 24, 2015.
Reasons
1. Facts of recognition;
A. The Plaintiff is the owner of the building 1st underground, 2nd floor underground, and 2nd floor of the ground located in Gangnam-gu Seoul Metropolitan Government (hereinafter “instant childcare center”), and operates C childcare centers in the said building.
The defendant is a company that performed the extension of D E hotel located adjacent to the child care center of this case (Gu Felel, hereinafter "the hotel of this case").
B. The hotel of this case was originally 4 floors of reinforced concrete structure. The Defendant changed the steel frame and reinforced concrete structure to the 6th floor without underground floors, and the 6th floor was extended from the 1st to the 6th floor without underground floors in light of the child-care center of this case, among the above parts, 3 floors were extended from the 5th to the 7th floor, and 6th floor was extended from the 2nd to the 7th floor at the 1st end of the right side (hereinafter “instant extension construction”).
C. The child-care center of this case is a building of the first and second floors underground, which has an underground floor at the center of the building, but was a relatively stable structure. As a result, the child-care center of this case caused the following damages to the child-care center of this case.
