1. The Defendants jointly and severally agreed to the Plaintiff KRW 31,254,120 and Defendant B Co., Ltd. from February 5, 2018.
Reasons
1. The following facts of recognition may be found, either in dispute between the parties (including the part in which the plaintiff is a person), in Gap evidence 1 to 4, and in Gap evidence 6-1 to 2, Eul evidence 1, 2, 3, and 4, together with the purport of the whole pleadings:
On June 17, 2015, the Plaintiff entered into a contract for the supply of ready-mixed (hereinafter “instant supply contract”) with Defendant B (hereinafter “Defendant Company”) on which the Defendant Company subcontracted part of the construction work to Nonparty D Co., Ltd. (hereinafter “Nonindicted Co., Ltd.”) at the site of the construction of the new building in Busan-gu E-gu, Busan, where the Plaintiff supplied ready-mixed and the price for which the Defendant shall pay. On the same day, Defendant C guaranteed the Defendant Company’s obligation to pay ready-mixed under the above contract with the Defendant Company.
B. From June 18, 2015, the Plaintiff supplied ready-mixed as indicated below according to the instant supply contract.
