1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
(1) On December 15, 2014, the Plaintiff entered into a lease agreement with the Defendant, setting the amount of 35 square meters among the buildings listed in the separate sheet No. 1 (hereinafter “instant building”) as KRW 15,000,000, monthly rent of KRW 1,800,000, and the term of lease as of December 15, 2016 (hereinafter “instant lease agreement”), and agreed that the Plaintiff and the Defendant jointly use the heating room No. 2, and that the electricity fee be half the amount between the Plaintiff and the Defendant.
⑵. 피고가 이 사건 건물 중 이 사건 임대차계약에 의하여 점유, 사용하는 부분은 1층 중 별지 2 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㄱ의 각 점을 차례로 연결한 선내 ㈎부분 98.1㎡, 2층 중 별지 3 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㄱ의 각 점을 차례로 연결한 선내 ㈏부분 37.2㎡, 3층 중 별지 4 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㄱ의 각 점을 차례로 연결한 선내 ㈐부분 26.5㎡(이하 ‘이 사건 임차부분’이라 한다)이고, 피고는 ㈎부분에서 고등어를 가공하고, ㈏부분은 사무실로, ㈐부분은 냉동창고로 사용하고 있다.
Secondly, on October 17, 2016, the Defendant sent to the Plaintiff a certificate of content to the effect that the Plaintiff would continue to use the leased portion of the instant case, thereby enabling the renewal of the contract.
x. The Defendant paid to the Plaintiff KRW 1.1 million monthly electric charges for the leased portion of the instant case, and paid the Plaintiff KRW 600,000 per month at the Plaintiff’s request in June, July, and August, 2015.

2. The parties' assertion
A. As Plaintiff (1) terminated on December 15, 2016, the instant lease agreement has expired, the Defendant must deliver the leased portion of this case.
② Even if the term of the instant lease agreement was not expired, the Plaintiff and the Defendant around September 2016.
