A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is a foreigner of the People's Republic of China.

1. Where a foreigner who enters an airport or harbor of Jeju Special Self-Governing Province without a visa to stay in the Jeju Special Self-Governing Province for the purpose of establishing the Jeju Special Self-Governing Province and passing through tourism in violation of the Special Act on the Development of Free International City, intends to move to another area within the territory of the Republic of Korea, he/she

On November 22, 2015, the Defendant, without a visa, entered Jeju Special Self-Governing Province for the purpose of nominal tourism (B-2) and was willing to move to Jeju Special Self-Governing Province for illegal employment without obtaining permission for extension of sojourn area.

On November 29, 2015, the Defendant entered the Jeju International Airport through Aircraft MU2543 in the Republic of Korea without a visa on November 29, 2015, the Defendant immediately paid the 5,000 proposal to the Jeju International Airport on December 1, 2015, in order to be employed in the Republic of Korea, as an intermediary fee, and moved to the Gwangju Metropolitan City from the same day after getting out of the cargo space of the vehicle on which the intermediary is driving, while moving to an unclaimed port on the same day after getting out of the cargo space of the vehicle on which the intermediary is driving.

Accordingly, the defendant entered the Jeju Special Self-Governing Province without a visa and moved to another area within the territory of the Republic of Korea without obtaining permission for extension of sojourn area.

2. Violation of the Immigration Control Act;

(a) No foreigner shall stay, beyond the scope of his/her sojourn status or period of stay;

Nevertheless, the Defendant entered Jeju Special Self-Governing Province without a visa, 30 days (B-2, the expiration date of the period of his stay) of the period of his stay in the Jeju Special Self-Governing Province without a visa, and stayed beyond the scope of the period of his/her stay without departure until the expiration date of the period of his/her stay.
