Defendants shall be punished by imprisonment for two years.

However, for three years from the date this judgment became final and conclusive, the above punishment against Defendant A.

Punishment of the crime

Defendant A, from October 1, 2010 to November 27, 2012, is a person who works as the deputy head of the business division of the Victim H, Inc., Ltd., located in Busan Seo-gu, and is engaged in the storage of freezing fishery products of the victim company, and Defendant B is a person who engages in the wholesale of fishery products as an I director of the corporation.

Since H, a financial company, obtained a loan from the Hyundai Social Co., Ltd. and the Korea Saemaul Savings Depository, and provided fishery products stored in H as a collateral for transfer, Defendant A had a duty to carry out the fishery products with prior consent of the above financial company, such as a delivery certificate, etc. at the time of release.

Nevertheless, around June 11, 2012, when Defendant A received request from Defendant B for the release of frozen fishery products offered as a security for transfer from Defendant B without a certificate of delivery from Defendant B, Defendant A in violation of his occupational duties and delivered 30 boxes offered as a security for transfer to Defendant B.

In addition, from March 5, 2012 to June 18, 2012, the Defendants conspired to take out the amount equivalent to KRW 96,146,00,00 from Hyundai Social Co., Ltd., which is a financial company, without prior consent, of the amount equivalent to KRW 96,146,00, and caused the victim to incur property damage equivalent to that amount.

The defendant B is a person engaged in the storage of frozen fishery products of the victim company while serving as the vice head of the business division of the victim (head of the state) G located in Seo-gu Busan from October 1, 2010 to November 27, 2012.

A victim company is from the village community credit cooperatives that are financial companies and the branch of South Korean bank South Korea.
