피고인은 2017. 4. 29. 11:34 경 부산 수영구 B 앞 노상에서, 술에 취해 바닥에 누워 잠을 자고 있던 중 112 신고를 받고 출동한 부산 남부 경찰서 C 지구대 소속 경찰관 경사 D이 피고인에게 일어나라고 한다는 이유로 D에게 “야 이 짭새들아. 네 가 참견할 일이 아니다 ”라고 말하며 가운뎃손가락으로 욕설을 하고, 주먹으로 때릴 듯한 태도를 취하고, 계속하여 같은 날 11:45 경 위 E에 있는 F 앞 노상에서 D과 함께 이동하던 중 같은 지구대 소속 경장 G에게 다가가 때릴 듯한 태도를 취하고, D에게 “야 이 씨 발 놈 아 ”라고 욕설하며 피고인의 오른쪽 어깨로 위 D의 오른쪽 어깨 부분을 밀치는 등 폭행하여 경찰공무원의 신고 출동 업무에 관한 정당한 직무집행을 방해하였다.
