1. The Defendant: (a) KRW 40,00,000 for the Plaintiff and the Plaintiff’s annual rate from January 25, 2019 to May 30, 2019; and (b) on May 31, 2019.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Judgment with no applicable provisions of Acts (Article 208 (3) 1 of the Civil Procedure Act);
3. According to the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings is 12% per annum from June 1, 2019. Thus, the part of the claim for damages for delay seeking payment exceeding the rate of 12% per annum from June 1, 2019 is rejected.
