A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

From September 2012 to December 2013, the Defendant had a relationship with the victim D (n, 24 years of age).

1. Around December 31, 2013, the Defendant violated the Punishment of Violences, etc. Act (a collective action, deadly weapons, etc.) committed assault against the victim on the ground that he/she continued to hear the horses of the victim, namely, the victim’s dwelling, from the victim, and requested the victim to return to the victim, but the victim said that he/she was said to be the victim’s refusal.

Accordingly, the defendant carried dangerous objects and threatened the victim.

2. On January 28, 2014, the Defendant: (a) demanded that the victim left the parking lot of the victim’s residence located in Seocheon-gu, Seocheon-gu, Seocheon-gu, Seoul; (b) the victim again refused this demand; (c) the victim threatened the victim that “I would spread the sexually related video prior to the hedge; and (d) on January 29, 2014, the victim would delete the screen image with the victim as he would put the victim into a room where the number of Gmotour in Guro-gu, Seoul would not be known.”

The Defendant, at the above heading room, threatened the victim to leak the video, and prevented the victim from sitting out of the room by putting the arms of the victim who tried to get out of the room, and demanded a sexual relationship continuously, but the victim refused to do so, and the victim refused to do so. As such, the Defendant forced the victim to commit a indecent act by force in response to the victim's entry even though the victim was frighten, by threatening the victim not to go in the telecom and by threatening him to spread the video.
