Punishment of the crime

[2015 Highest 2993] On December 3, 2014, the Defendant phoneed to C, the vice head of the victim corporation B, and imported the measuring instrument “(s) from D to a domestic and foreign bankruptcy administrator, including, but not limited to, 2,850,000 won, to supply it to L-to-door thermal power plants.”

When selling the above measuring instrument in 2,00,000 won per unit of 2,000,000 won, 850,000 won per unit can be paid per unit of the power plant, and the above equipment can be supplied to the State agency continuously.

It is intended to supply the 11,000,000 won, including the five price for the 5 measuring instrument and the 10% value added, to the 11,00,000 won, and complete the installation of the 11,00,000 won.

However, the Defendant was unable to sell the said measuring instruments at Pyeongtaek-si thermal power plant because of the lack of relationship with the Pyeongtaek-si thermal power plant, and there was no intention or ability to let the company working for the victim become the registered company of the Pyeongtaek-si thermal power plant.

The defendant deceivings the victim as above and transferred 11,00,000 won to a new bank account in the name of E designated by the defendant around December 5, 2014 from the victim.

[2015 Highest 3945] On March 31, 2015, the Defendant calls from G office located in Seongdong-gu Seoul Metropolitan Government F to the victim H, and sells 3,550,000 won per unit of 1 unit 2,80,000 won at Pyeongtaek-si Power Station. The Defendant may pay 750,000 won if he/she supplies the said goods to the Pyeongtaek-si Power Station. If he/she supplies two sets of goods to the Pyeongtaek-si Power Station, he/she can be continuously supplied to the Pyeongtaek-si Power Station by being a registered company of the Pyeongtaek-si Power Station.

On the face of the two costs of the above machinery and the value added tax, the above machinery will be supplied in the name of G at the Pyeongtaek Power Station and completed the installation thereof.
