1. The Defendant (Counterclaim Plaintiff) paid KRW 15,00,000 to the Plaintiff (Counterclaim Defendant) and its amount from July 21, 2018 to May 31, 2019.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Facts of recognition;

A. The plaintiff and C are legally married couple who completed the marriage report on August 21, 2002, and they have D(2005) and E(2006) under the sleep.

B. Around June 19, 2018, the Defendant came to know of C while attending a church, and the Plaintiff sent text messages containing the contents that Defendant and C “I want to love and report” as mobile phones, and confirmed that C’s mobile phone has pictures fit for the Defendant and C with the Defendant.

C. Although C received from the Plaintiff a demand from the Plaintiff that the Defendant re-satisfy the Defendant, C, on June 21, 2018, she did not go against the Defendant, such as joining the Defendant in the workplace or in the train, and she also went to the motel.

On June 22, 2018, the Plaintiff prepared a written confirmation (hereinafter referred to as “instant written confirmation”) stating that “The Defendant will not be present in the future. I will accept any request of the Plaintiff if I have any remainder of Korea” (hereinafter referred to as “instant confirmation”).

E. The plaintiff is above C.

After confirming the behavior of C and the defendant, C and C were seriously disputed with C, and C came to work around July 3, 2018.

F. From July 3, 2018 to July 26, 2018, the Plaintiff sent several text messages to the effect that “I wish to the Defendant, or “I proceed with the litigation if I and public, private, male, etc. are not cut off, and I wish to know the Defendant’s family members, and the Defendant’s church going to the Defendant’s church.”

G. On August 1, 2018, the Plaintiff: (a) discovered the Defendant’s domicile where the Defendant’s mother was living in an unsound manner; and (b) found the Defendant’s mother at his domicile around August 10, 2018; (c) sought the Defendant’s domicile and met the Defendant’s wife.

H. C returned to the home again, and thereafter, on August 7, 2018, filed a lawsuit against the Plaintiff for a claim for divorce, etc. (hereinafter “instant claim for divorce, etc.”) against the Suwon Family Court (hereinafter “instant claim”).
