A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person engaging in driving a rocketing car.

1. On October 15, 2017, the Defendant: (a) driven the said car while under the influence of alcohol at around 15:30 on October 15, 2017; (b) led the Defendant to the intersection of the distance prior to the 119 Center of Gyeonggi-gu, Gwangju-si, and (c) bypassing the intersection of the distance from the boundary of the police box C at both sides.

In this case, a person engaged in driving service has a duty of care to prevent various accidents by reducing speed in advance and safely examining the left and right well.

Nevertheless, the Defendant neglected this and went beyond the left-hand side by his negligence before the right-hand as it was, and the victim D(42 Do, n)'s E-learning car stopped in order to turn to the left-hand side from the right-hand side, and the Defendant conflicts with the front-hand side of the driver's driver's driver's left-hand side.

As a result, the Defendant driven the said car in a state where normal driving is difficult due to influence of drinking, and suffered from the victim D’s salt ties, tensions, etc., which require two-day medical treatment, and the victim FF (five years of age and south) who was on board the damaged vehicle, for about two-day medical treatment.

2. The defendant, who violated the Road Traffic Act (Refusal of measurement of drinking), driven a motor vehicle while under the influence of alcohol, such as smelling the defendant from a slope G of the Gwangju Police Station C police box called after receiving a report on the same traffic accident as referred to in paragraph (1) of the said Article, while under the influence of alcohol, such as taking a breath on the inside.

Since there are reasonable grounds to determine a person, it was demanded to respond to the measurement of drinking at intervals of five minutes by inserting the whole in a drinking measuring instrument three times at intervals.

Nevertheless, the defendant avoided this and did not comply with a police officer's request for a measurement of drinking without justifiable grounds.
