피고인은 2017. 10. 15. 02:00경 제주시 B에 있는 C 유흥주점 4번 룸에서, 그곳 종업원인 피해자 D(여, 26세)를 옆에 앉히고 함께 술을 마시던 중, 갑자기 피해자의 원피스 목 부위로 손을 넣어 피해자의 가슴을 만진 후 치마 밑으로 손을 넣어 피해자의 음부 쪽을 만지고, 피해자가 “하지 말라”고 수회 거부하며 피고인의 손을 뿌리쳤음에도 옆으로 누워 피해자의 왼쪽 엉덩이를 이로 물고, 이에 피해자가 피고인의 왼쪽 손목을 물며 거부의사를 표현하였음에도 강제로 피해자의 가슴을 브래지어에서 빼 낸 후 젖꼭지 부분을 혀로 빨아 추행하였다.
