Defendant shall be punished by a fine of KRW 300,000.

If a fine is not paid, 50,000 won shall be converted into one day.

Punishment of the crime

To the extent that it does not impede the guarantee of the defendant's right to defense, the facts charged shall be revised and recognized as follows:

피고인은 성남시 수정구 C 2층에서 ‘D’이라는 상호로 유원시설을 운영하는 사람인데, 2012. 3. 25. 16:00경 위 업체의 놀이기구 중 “디스코 팡팡”에 피해자 E(여, 14세) 등 승객 10여 명을 태우고 놀이기구를 운행함에 있어, 위 “디스코 팡팡” 놀이기구는 상하좌우로 회전시키는 등의 방법으로 운행하면서 승객이 넘어져 다칠 수 있는 위험이 있으므로, 안전관리자를 상시 배치하고, 유기기구 운행자에 대하여 승객들의 안전에 유의하고 운행수칙을 지켜 안전하게 운행하도록 충분히 교육을 하고 감독을 하여 안전사고를 방지하여야 할 업무상 주의의무가 있었다.
