Defendant shall be punished by a fine of KRW 10,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

[Criminal Power] On July 18, 2016, the Defendant was issued a summary order of 1.5 million won by the Incheon District Court for a violation of the Road Traffic Act (driving).

【Criminal Facts】

At around 02:00 on September 25, 2019, the Defendant driven a motor vehicle with the highest alcohol level of 0.059% from the front of the Suwon-gu apartment B apartment in Suwon-si to the Hanwon-si Heung-si Heung-gu Heung-gu, and the vehicle with the highest alcohol level of about 10km in the section of 10km from the front of the Suwon-gu, Suwon-si to the Hanwon-gu, Suwon-gu.

Accordingly, the defendant was driving under drinking not less than twice.

The reason for sentencing under Article 334(1) of the Criminal Procedure Act of the provisional payment order [the scope of punishment] 10 million won or more to 20 million won (the decision of sentence] has recently been subject to criminal punishment due to a drunk driving, and the defendant repeats again even though he had recently been subject to criminal punishment, and the nature of the crime is not weak.

However, considering the fact that the defendant is led to confessions and reflects by the defendant, there is no previous conviction in excess of a fine yet, second year in 2018, that the death of his/her father depends on alcohol due to a physical disorder, and that the previous day of the case was driving after drinking alcohol and the blood alcohol concentration level was not relatively high since he/she got on the new wall, the punishment shall be determined as ordered by taking into account various sentencing conditions shown in the records and arguments, such as the defendant's age, attitude, environment, circumstances after the crime, etc.
