Reasons
Punishment of the crime
[criminal record] On August 19, 2015, Defendant A was sentenced to a suspended sentence of two years in October 10 and the above judgment was finalized on the 27th of the same month, due to the crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Daejeon District Court's red support.
[Criminal facts]
1. Defendant A conspired to receive insurance money by causing a false traffic accident between G and a high-speed-friendly relationship, and then, on April 25, 2012, at the frame ahead of I’s home transfer located in Boan City H around 23:45 on April 25, 2012, G parked his own Jkeer vehicle, and the Defendant intentionally caused a traffic accident by receiving from the front wheeler’s driver’s seat on the lane of his own KIIser vehicle to be cut off, and the Defendant immediately called “the accident was caused by contact with the vehicle parked in WIser,” while claiming the payment of compensation as if the traffic accident was caused by negligence.
However, the above accident was planned and caused by the defendant and G to divide insurance money.
Nevertheless, as if the above accident occurred due to the negligence of the defendant, the defendant and G had a total of KRW 13,355,390 on June 27, 2012 by deceiving the victim company as if the above car was damaged, the defendant and G received a total of KRW 13,355,390 from the victim company.
Accordingly, the defendant, in collusion with G, acquired a total amount of KRW 13,355,390 from the injured party.
2. Defendant C and Defendant B conspired to receive insurance money by causing a false traffic accident between G and acquiring insurance money. On August 15, 2012, at the entrance road of the government-run Si of Boan-si, Boan-si on August 15, 2012, G parked his own Jkeer vehicle, and then driving the said C-owned vehicle, driving the said C-owned vehicle from the front wheels of the driver’s seat of the said C-owned vehicle.
