1. All appeals filed by Defendant (Counterclaim Plaintiff C) against the instant principal lawsuit and counterclaim are dismissed.

As the main lawsuit of this case, the Plaintiffs filed a return of the deposit money for the lease contract with each of the Defendant C as the main defendant, and the Defendants filed a claim for damages with each of the ancillary defendants. Defendant C filed a claim for the return of each of the unjust enrichment against the Plaintiffs as the counterclaim of this case.

이에 제1심법원은 ① 원고 B의 본소청구 중 ㈀ 피고 C에 대한 주위적 청구를 일부 인용하고, 나머지 주위적 청구(지연손해금 중 일부)를 기각하며, ㈁ 주위적 청구가 인용되었음을 이유로 피고들에 대한 예비적 청구를 모두 기각하고, ② 원고 A의 본소청구 중 ㈀ 피고 C에 대한 주위적 청구를 기각하고, ㈁ 피고 C에 대한 예비적 청구를 일부 인용하고, 나머지 예비적 청구를 기각하며, ㈂ 피고 D에 대한 예비적 청구를 기각하고, ㈃ 피고 E에 대한 예비적 청구를 인용하며, ③ 피고 C의 반소청구는 모두 기각하는 내용의 판결을 선고하였다.

With respect to the above judgment, only the defendant C appealed against the defendant as to the main lawsuit and counterclaim. ① The main claim against the plaintiff Eul and the main claim against the defendant D and E are excluded from the scope of the judgment of this court. ② The main claim against the plaintiff Eul and the main claim against the defendant Eul are in a relationship of subjective preliminary co-litigation as stipulated in Article 70 of the Civil Procedure Act. If either the main co-litigants or the conjunctive co-litigants file an appeal against the defendant, the confirmation of the claim against the other co-litigants is prevented and they are transferred to the appellate court for the trial (see, e.g., Supreme Court Decision 2006Du17765, Mar. 27, 2008). The main claim against the plaintiff Eul and the defendant D are included in the subject of the judgment of this court.
