1. The defendant is against the plaintiffs:

(a) deliver the buildings listed in the separate sheet;

B. From January 1, 2016, the foregoing shall apply.

1.The following facts of recognition may be found either in dispute between the parties or in full view of the purport of the entire pleadings as stated in Gap evidence 1 to 4, 7, 9, 10, Eul evidence 1 to 3, and 5 (including the number of branches).

On April 1, 2008, the Defendant, who leased and occupied the buildings listed in the separate sheet (hereinafter “instant building”) owned by D as commercial buildings, concluded a lease agreement (hereinafter “previous lease agreement”) with the lease deposit amount of KRW 5,000,000, monthly rent of KRW 400,000, and the lease term of KRW 12 months from April 1, 2008.

B. The former lease was renewed under the same conditions despite the expiration of the above lease term.

C. Meanwhile, the Plaintiffs jointly purchased the instant building from D on May 9, 2013 and completed the registration of ownership transfer on each half of the 29th of the same month.

On August 30, 2013, the Plaintiffs concluded a lease agreement (hereinafter “instant lease agreement”) between the Defendant and the instant building, which is KRW 5,000,000 per month, KRW 500,00 per month, and KRW 24 months from May 1, 2013.

E. After October 30, 2014, the Plaintiffs notified the Defendant that the instant lease contract should not be renewed, and that the instant building should be transferred immediately after the expiration of the said lease term (hereinafter “instant renewal notification”).

F. The Defendant continuously occupied and used the instant building from before the time of acquiring the instant building’s ownership to the date of closing of argument. From the time of acquiring the Plaintiff’s ownership to the time of concluding the instant lease agreement, KRW 400,000 per month under the previous lease agreement, and KRW 500,00 per month from the time of concluding the instant lease agreement to December 30, 2015, respectively, was paid to the Plaintiffs as rent, according to the instant lease agreement.
