나. 성폭력범죄의처벌등에관한특례법위반(친족관계에의한강간) 1) 피고인은 2017.경 대구 서구 E건물 F호 소재 피고인의 집 거실에서, 그 곳에 누워 있던 피해자 B(여, 13세)의 옷을 벗기고, 손으로 피해자의 가슴을 만지고 입으로 피해자의 가슴을 빤 후 피해자의 배에 키스를 하였고 이에 피해자가 “하지 말라”라고 말하며 피해자의 다리로 피고인의 다리를 차며 반항하자 피해자에게 “가만히 있으라”라고 말하는 등 피해자에게 겁을 주어 피해자가 반항하지 못하게 한 후 피고인의 성기를 피해자의 음부에 삽입하였다. 이로써 피고인은 친족관계에 있는 피해자를 강간하였다. 2) 피고인은 2018.경 대구 서구 E건물 F호 소재 피고인의 집 거실에서, 그 곳에 누워 있던 피해자 B(여, 14세)의 양가슴과 배를 입으로 빤 후 피해자의 바지와 팬티를 벗겼고, 이에 피해자가 “그만하라고”라고 소리치자 손으로 피해자의 양 손목을 잡아 피해자가 반항하지 못하게 한 다음 피고인의 성기를 피해자의 음부에 삽입하였다.
