A defendant shall be punished by imprisonment for a term of one year and four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

[Criminal Power] On December 14, 2007, the Defendant was sentenced to a fine of KRW 3 million by the Busan District Court due to a violation of the Road Traffic Act (driving).

【Criminal Facts】

1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) by the Defendant is a person engaging in driving a rocketing or other car.

On June 26, 2020, the Defendant driven the said car under the influence of alcohol of 0.10% with blood alcohol concentration of 0.10% on June 23:16, 2020, and led the said car to proceed from the side of the hospital to the shipping line.

At the time, there was a intersection where a yellow flickering lights are installed on the front side of the night, and there was an intersection where a yellow flickering lights are installed on the front side, so there was a duty of care to prevent accidents in advance by driving the vehicle by checking whether there was a vehicle entering the intersection by reducing the speed and checking well the front side.

Nevertheless, the defendant neglected this and went to the right side of the vehicle that is driven by the victim F (F, South, 59 years old) who is going to go directly to the right side of the road in the direction of the defendant's proceeding by the negligence of entering the intersection.

Ultimately, the Defendant suffered injury to the victim F and the victim H (the 58 years old), victim I (the 33 years old age), each of which requires approximately two weeks medical treatment, and the victim J (the South, the 23 years old age) who was on board the said Bosch Rexton car due to the occupational negligence as above. The Defendant suffered injury to the victim J (the 23 years old) who was on board the said Boschton car with approximately two weeks of medical treatment.

2. The Defendant violated the Road Traffic Act (driving) driving a rocketing car as described in paragraph (1) while under the influence of alcohol of about 600 meters in a section of approximately 600 meters from the west-gu, Busan to the area where paragraph (1) was located.
