The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds of appeal cited a knife and threatening the victims, and its time has passed about 30 minutes and had been on the site.
In light of the fact that I et al. did not get out of the place of gambling, it is reasonable to view the Defendant’s act as an objectively sufficient act to have a person spread out of the place of gambling and to constitute intimidation as referred to in the crime of intimidation. F and G paid money out of the Defendant’s intimidation.
Although it is reasonable to regard the defendant as not guilty, the court below erred by misunderstanding the facts or misunderstanding the legal principles.
2. Determination
A. From around 21:00 on December 8, 2013 to 03:00 on the following day, the Defendant: (a) within the E flag area in Suwon-gu, Suwon-si, the victim F (56 years of age), G (51 years of age), H (62 years of age), I (59 years of age); and (b) 1.9 million won was lost, among six strings, namely, “arobine,” the victim was frighted, and 1.9 million won of a deadly weapon located therein; and (c) 1.9 million won was cut off, the Defendant she sawd the victims of the charges two times, and she she she she was frighted from the victim with the first math, she was fright, she was frighten, she was frightd from the victim, and she was frightd from the victim’s her opening to the victim, and she was frightd from the victim.”
B. The lower court determined as follows: (a) according to the Defendant’s partial statement in the lower court’s lower court’s trial and the police’s respective statements, F, and G’s respective statements at the court of the lower court’s trial; (b) following the Defendant’s gambling with F, G, H, I, and I on December 8, 2013; and (c) gambling with F, H, H, and I on the following day; (b) gambling was terminated at around 03:00 on the following day; and (c) the Defendant spawddd by interesting in having lost money in gambling.
J and trial costs have been discussed, and thereafter the chair has been placed in front of the entrance.
