1. The Plaintiff:
A. Defendant A Co., Ltd.: (a) KRW 10,269,022,756 and KRW 2,764,709,90 among them; and (b) November 1, 2016.
Reasons
Basic Facts
The Plaintiff entered into a credit transaction agreement with Defendant A Co., Ltd. with an interest rate of 13,800,000,000,000 per four times as listed below, and extended a total of 13,000,000,000 won per four times as shown in the table below to the 12,000,000 B 15,60,000,000 of the limit of the total amount of loans for the collateral guarantee for the collateral guarantee for the collateral guarantee for the collateral guarantee for the collateral guarantee for the collateral guarantee for the collateral guarantee for the collateral guarantee for the loans of 12,00,000,000 general loans for 20,500,000 B 650,000,0000, 390, 390,000 B,000,000, 300,004, 300,300,004, 3000
(hereinafter “instant loan”). Among them, loans Nos. 1 among them were loaned by the Plaintiff to Defendant C Co., Ltd., but Defendant A Co., Ltd. acquired its obligation on June 13, 2008 following the merger of Defendant A Co., Ltd.
The Defendants delayed the repayment of principal and interest of the instant loan and lost the benefit of time. On November 16, 201, the Plaintiff, in the D Voluntary Auction case of Seoul Southern District Court, 5,679,045,385 won, and on December 7, 2011, received dividends of KRW 4,91,581,987 from the Daejeon District Court E Voluntary Auction case, and appropriated them for the repayment of part of principal and interest.
On October 31, 2016, the outstanding principal and delayed payment of the instant loan that the Defendants did not pay as of October 31, 2016 are KRW 10,269,022,756 in total as listed below.
