Reasons
1. Details of the disposition;
A. On June 20, 2008, in order to secure the claim of KRW 900,00,000 for the Yucheon Rebuilding Housing Association that constructed the instant apartment, A completed the registration of creation of a collateral security right (hereinafter “instant collateral security right”) with respect to the instant apartment among the instant apartment units, KRW 205, KRW 206, KRW 207, KRW 207, KRW 209, KRW 211, and KRW 212, KRW 212 (hereinafter “each auction apartment”) and the instant real estate. The Plaintiff completed the registration of establishment of a collateral security right (hereinafter “instant collateral security right”) on February 26, 2014 due to the transfer of finalized claim on January 3, 2014.
B. As to each auction apartment of this case, Daejeon District Court, Daejeon District Court, Daejeon District Court No. 17322 received on April 1, 2009, completed the attachment registration, and the defendant Daejeon Metropolitan City completed the attachment registration under the receipt of the same registry office on April 9, 2009.
C. With respect to each of the auction apartments of this case, this court started the auction procedure for real estate rent (hereinafter “instant auction procedure”). At the auction procedure of this case, Daejeon District Court filed an application for the issuance of the above total of the tax claim amounting to KRW 53,508,530 on July 27, 2008, the statutory deadline for interim prepayment / value-added tax of KRW 53,508,530 on July 2008, the statutory deadline for payment, KRW 27,650,570 on July 23, 2009, the statutory deadline for payment of value-added tax of KRW 5,301,250 on May 1, 2009, and KRW 5,30 on December 4, 2008, KRW 609, KRW 910 on July 1, 200, KRW 96, KRW 9610 on July 26, 2006 (the above taxation claim of this case).
An application for delivery was filed. D.
On the date of distribution of the auction procedure of this case, KRW 91,269,960 out of the amount of KRW 115,063,770 to be distributed to Defendant Daejeon Metropolitan City is the defendant.
