A defendant shall be punished by imprisonment for six months.

피고인은 2019. 8. 28. 10:00경 용인시 처인구 B아파트 C동 옆 분리수거장에서, 마침 그곳 아파트 C동 엘리베이터를 타고 내려오던 중 마주친 피해자 D(가명, 여, 36세)이 분리수거장으로 가는 것을 발견하고 피해자를 뒤따라가 피해자가 분리수거를 하고 있는 틈을 이용하여 피해자의 뒤로 다가간 후 피고인의 아이폰7 휴대폰 카메라 기능을 이용하여 피해자의 치마 안쪽 신체를 동영상 촬영하려 하였으나, 피고인이 카메라 기능을 켠 후 피해자의 치마 안으로 휴대폰을 집어넣고 있는 것을 발견한 피해자가 소리를 지르자 그 자리에서 도주함으로써 미수에 그쳤다.
