Defendant shall be punished by a fine of 1.5 million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

No one shall receive protection and settlement support for residents escaping from North Korea or receive protection or support from any third person by fraud or other improper means.

Nevertheless, the Defendant knew that North Korean defectors, who had continued to be employed in the same company for at least one year in the name of employment incentives for the settlement support and employment support of North Korean defectors who are eligible for employment protection in the Ministry of Unification, in the Ministry of Unification, have been paid KRW 4,50,000 (2,00,000 in the case of those who have worked for at least six months but less than one year), KRW 5,50,000 in the year, KRW 50,000 in the second year, and KRW 6,50,000 in the third year, and that the Defendant had been staying in a foreign country including Germany from November 28, 2013 to September 20, 2014, while having been staying in the Republic of Korea for the above period, the Defendant had received money in the name of employment incentives from the Ministry of Unification by preparing and submitting a false written confirmation of employment, etc. as if they were working in Korea.

Accordingly, on November 21, 2014, the Defendant sought employment incentive of KRW 4.5 million by submitting a false certificate of work and a copy of passbook to the effect that he/she worked as an employee even though he/she had worked as an employee from September 1, 2013 to September 30, 2014, to a public official in charge of obtaining no name from the Daegu Local Employment Support Center located in Suwon-gu, Daegu-gu, Daegu-gu, (hereinafter referred to as the “Korea Employment Support Center”) and from September 1, 2013 to September 30, 2014, the Defendant failed to obtain employment incentive of KRW 4.5 million by presenting a false certificate of work and a copy of passbook, etc.
