Reasons
1. Facts constituting the premise
A. The Plaintiff entered into a credit guarantee agreement as set out in the table 1 below in order to guarantee the payment of the principal and interest of loans to the Industrial Bank of Korea, in order to ensure the payment of the principal and interest of loans, between the Young-gu Commercial Bank Co., Ltd. (hereinafter referred to as the “Seoul Commercial Bank”).

B. The Industrial Bank of Korea concluded a comprehensive collateral security contract with respect to the land lot of 253-4 10,836 square meters and its ground building (hereinafter “each real estate of this case”) in order to secure the obligations to be borne at present and in the future with respect to the Industrial Bank of Korea (hereinafter “the Bank of Korea”) in order to ensure the obligations to be borne at present and in the future, as set forth below [Attachment 2].

On December 5, 2008, the Industrial Bank of Korea loaned 1,200,000,000 won as a credit guarantee of Nos. 1 of [Attachment 1] and No. 1 collateral security to the KCF as a security for small and medium enterprise driving funds. On February 20, 2009, the Industrial Bank of Korea loaned 300,000,000 won as a special support fund as security by the No. 2 credit guarantee of No. 1 [Attachment 1], and on February 24, 2009, borrowed 1,00,000 won to the KCFF as a security for small and medium enterprise driving funds.
On August 2, 2012, the Industrial Bank of Korea, which was unable to repay the principal and interest of loans, filed an application for voluntary auction to exercise the right to collateral security in this case with the Cheongju District Court Branch on August 2, 2012, and the same court (hereinafter referred to as the "auction court") shall be the same court on August 208.
