1. A deed drawn up on June 11, 2012 by a notary public with the Defendant’s executory power against the Plaintiff is signed by Cjoint Law Office.
Reasons
1. Facts of recognition;
A. The Plaintiff is the representative of D Co., Ltd. (hereinafter “D”).
As seen thereafter, the Defendant paid money to “G company” (hereinafter referred to as “G”) operated by E (name F prior to the name of the name of the name) and is a person who prepared and delivered the notarial deeds as referred to in paragraph (1) of this Article from the Plaintiff.
B. The conclusion of the instant loan transaction agreement and the process of paying the loans thereafter, KRW 50 million, KRW 30 million, KRW 30% per annum, interest rate of KRW 38.4% per annum, overdue interest rate of KRW 50 million on May 14, 2012, and KRW 30 million on the date of repayment, KRW 30% per annum, the debtor, the debtor, the joint guarantor, KRW 40% per annum, overdue interest rate of KRW 38.4%, interest rate of KRW 38.4% on the date of loan, and November 13, 2012 on the date of loan, KRW H, the Plaintiff’s agent, requested for the lending of money to G office around May 2012, KRW 201 and KRW 4.5% on the loan agreement of KRW 54% on the loan agreement (hereinafter “No. 2514, May 14, 2012”). The Plaintiff’s agent, pursuant to the G employee’s instruction, requested the creditor for the loan agreement as follows.
In addition, on May 14, 2012, the Plaintiff and H drafted each of them as “the amount of KRW 550 million, the issuer, the Plaintiff, and the date of preparation,” and “the recipient” on May 14, 2012 without receiving the loan under the instant loan transaction agreement, and the “amount of KRW 825 million, the amount of face value, the issuer, the date of payment, the date of payment, and May 14, 2012” respectively. The Plaintiff and H respectively written a promissory note (Evidence 4-6) in which the payee’s column is a blank space (the “amount of KRW 50 million, the date of payment,” and the “amount of KRW 450,50,00,00,000,000,000,000,000,0000,000,000,000,000,000).
