Defendants shall be punished by imprisonment for one year.
However, for two years from the date this judgment became final and conclusive, the above punishment against Defendant B.
Reasons
Punishment of the crime
In the event of being hospitalized due to disease and disaster, the Defendants were hospitalized, or received hospitalized treatment more than necessary thanks to the necessity after having repeatedly subscribed for an accident insurance for which the payment of the day of hospitalization is made in proportion to the number of days of hospitalization, and the Defendants were able to receive insurance money from the insurance companies that subscribed

On March 20, 2006, the Defendant stated that “The Defendant paid the insurance money under the terms and conditions to an employee who was hospitalized at the E Hospital located in Busan Jin-gu, Busan, for 22 days from January 23, 2006 to February 13, 2006, because the Defendant received hospitalized treatment due to the main high blood pressure at the E Hospital located in Busan, Busan, for 22 days from January 23, 2006 to February 2006.”
However, the fact was that the hospital received hospital treatment more than necessary even if it is possible to receive hospital treatment or in a short period of time.
As such, the Defendant, by deceiving the above employees, received KRW 1,143,653 as insurance money from the victim interesting life (the State) around April 14, 2006, and received KRW 1,143,653 as insurance money. From that time to July 22, 2011, the Defendant received KRW 226,423,815 in total as insurance money from 14 damage insurers after being hospitalized for 333 days after being hospitalized for 15 days as shown in attached Table 1.

Defendant B stated, around August 28, 2006, that “The Defendant paid insurance money according to the terms and conditions to an employee who was hospitalized in Busan Jin-gu for 20 days from July 10, 2006 to July 29, 2006 due to a 20-day other spine disease, etc., and was hospitalized in Busan Jin-gu for 20 days from July 10, 2006 to July 29, 2006.”
However, the fact is more necessary even if it is possible to provide hospital treatment or in a short period of time.
