A defendant shall be punished by imprisonment for not less than two years and six months.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

At around 15:00 on September 6, 2019, the Defendant discovered the victim D(name, finite, 9 years of age) that passed, and had the victim committed an indecent act.

피고인은 피해자에게 다가가 불상의 외국인 여성을 같이 찾아달라고 말하면서 피해자를 위 C학교 건물 1층에서 시설개선공사를 하고 있어 비어있는 방실로 유인한 다음, 피해자의 뒤에서 양팔로 피해자를 끌어안아 움직이지 못하게 한 다음 피해자의 배를 만지고, 허리를 위아래로 움직여 피고인의 성기를 피해자의 엉덩이에 비볐으며, 이어서 방 안쪽에 있던 세탁실로 피해자를 데리고 가 그곳에 피해자를 눕힌 뒤 피고인의 바지를 내려 피해자로 하여금 이를 보게 하고, 계속하여 피해자를 다시 방으로 데리고 나와 그곳에서 같은 방법으로 피해자의 배를 만지고 피고인의 성기를 피해자의 엉덩이에 비볐다.

Accordingly, the defendant committed an indecent act against the victim under 13 years of age.
