1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On February 2, 2013, Defendant C leased 102, Dong 1, Gwanak-gu, Seoul Special Metropolitan City (hereinafter “instant housing”) from the Plaintiff to 70 million won a monthly rent of KRW 50,000,000,000 from March 31, 2013 to March 30, 2015. At the time, Defendant C drafted a lease agreement (Evidence 2) in the name of Defendant B, the mother of the government, on the ground that, if the government entered into a lease agreement under its own name, it would be unlikely to receive the payment for Han parent’s own family.
On the other hand, the above lease agreement was concluded by Defendant D, a licensed real estate agent who was requested to act as a broker by the Plaintiff, and Defendant E, a licensed real estate agent who was requested by Defendant C.
B. At the early stage of the lease, Defendant C demanded the Plaintiff to repair or replace the long-term shocking net of the instant house, but there was a dispute between the Plaintiff and his first refusal.
(In conclusion, on May 30, 2013, the procedure for compulsory auction was initiated by the Plaintiff’s creditor G, etc. with respect to the instant housing. Defendant C, who caused uneasiness, raised an objection against the Plaintiff, and Defendant C again prepared a lease agreement (No. 3) in the name of Defendant C in the name of the Plaintiff on September 2013, as the name of the lessee and the real resident under the lease agreement may not be recognized as a lessee with opposing power in the procedure for compulsory auction. In that process, Defendant C and the Plaintiff had a good appraisal.
C. As Defendant C and the Plaintiff decided not to renew the above lease, the Plaintiff requested Defendant D to mediate the lease agreement with the new lessee around October 2014.
Accordingly, on February 13, 2015, Defendant D mediated a contract for the lease of the instant housing to the new lessee H by setting the rent of KRW 600,000,000 per month from March 15, 2015 to March 14, 2017.
