1. Facts of recognition;

A. At around 197, the Defendant, as a medical specialist outside the heart, developed C(C; hereinafter “C surgery”). C surgery is an operation to restore the function of the plate by fixing around the plate so as to perform functions similar to the plate. B. The Defendant asserted C surgery as a new effication method that it is unnecessary to cover a lifelong anti-emergency system and to reparate it into metal plates, and the stability of surgery is also guaranteed to the Health Insurance Review and Assessment Service on March 22, 2007. The Health Care and Assessment Service established the C surgery on April 24, 2009, and submitted the C surgery to the Health Insurance Review and Assessment Service (hereinafter “Health & Assessment Service”) on the ground that the C surgery was conducted within 10 research and effective effication guidelines for the health care of the Plaintiff and the Korea Health and Medical Service Research Institute (hereinafter “Health Care & Assessment Service”) on condition that the C surgery would be conducted within 20.5 years of research and effective effication guidelines for the health insurance policy.
