1. Basic facts

A. The Plaintiff is a company aimed at the design, supervision, and construction business of machinery, fire-fighting, electricity, and information and communications facilities. The Defendant is an association established for a housing redevelopment improvement project under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “instant project”).

B. On March 20, 2019, the Defendant Cooperative held a meeting of representatives of the 38th Council and resolved to proceed with the procedures for bidding to select a collaborative company for fire-fighting and information and communications construction supervision. On March 22, 2019, the Defendant Cooperative attached a list of marks indicating qualification of a collaborative company for fire-fighting and information and communications construction supervision in the electronic procurement system of the Public Procurement Service (hereinafter “qualification examination table”) and attached a list of marks indicating qualification of a collaborative company for fire-fighting and information and communications construction supervision (hereinafter “qualification examination table”) to select a collaborative company for the instant project

(hereinafter referred to as the “instant public tender notice”); 3. Bidding method: The method of qualification examination as an electronic bid by the Public Procurement Service;

The Defendant Union finds out the omission of the standard amount necessary for examining the qualifications to have been registered in the electronic procurement system of the Public Procurement Service at the time of the public announcement of the instant tender, and found the standard amount to be KRW 900,000,000 in a closed manner on March 28, 2019.
