A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On November 24, 2004, the Defendant was sentenced to a fine of two million won for larceny, etc. in the Dong branch of the Daegu District Court. On July 5, 2005, the Defendant was sentenced to a fine of two million won for the same crime, etc. in the resident support district of the Daegu District Court. On December 5, 2005, the same court was sentenced to a fine of three million won for the same crime, etc. on December 5, 2005. On January 4, 2007, the Defendant was sentenced to imprisonment with prison labor for the same crime, etc. on the same date in the gender support district of the Daegu District Court. On October 8, 2009, the Defendant was sentenced to imprisonment with prison labor for six months from the resident support district of the Daegu District Court for special larceny. On February 15, 2011, the said court was sentenced to imprisonment with prison labor for one year and six months for the violation of the Aggravated Punishment Act and completed the execution of the sentence on June 29, 2012.

Criminal facts

around 11:00 on December 24, 2013, the Defendant driven the C stud-off truck without obtaining a driver's license in the section of about 20km from the front side of the Samsung Middle School located in the inside-gun of Seongbuk-gun, Chungcheongnamcheon-gun, Gyeongcheon-gun to the last day of 14:30 on the same day.

1. The Defendant violated the Road Traffic Act (unlicensed driving) from around 10:00 on July 25, 2013 to around 11:00 on the same day, driving a C wing-off truck without obtaining a driver’s license at the distance of about 60km to the Defendant’s home, going through the E stable located at the port of mountain, and going back to and from the 60km away from the Defendant’s house.

2. From around 10:00 on July 25, 2013 to 11:00 on the same day, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) went into a stock farm shed listed in paragraph (1) and carried approximately KRW 30,000 of the market price owned by the victim F, which was kept in the relevant place, on the spot, approximately KRW 30,00 of the market price.

Accordingly, the defendant habitually stolen the victim's property.
