1. The Defendant’s KRW 4,067,106 and the annual rate of KRW 5% from August 20, 2013 to September 8, 2016 to the Plaintiff.
Reasons
1. Basic facts
A. The Defendant (1) was a financial investment business entity with the purpose of investment brokerage business, etc. as prescribed by the Financial Investment Services and Capital Markets Act (hereinafter “Capital Markets Act”), and was an affiliated company of a business group comprised of C Co., Ltd. (hereinafter “F”), F Co., Ltd. (hereinafter “F”), and D Co., Ltd. (hereinafter “D”), and was incorporated into H’s affiliated company from June 11, 2014.
(2) On May 4, 2012, the Dispute Resolution Co., Ltd. publicly offered non-guaranteed option bonds of each credit assessment rating BB, each of which was issued on September 26, 2012, each of which was December 24, 2012, December 257, 2012, June 7, 2012, July 4, 2012, July 260, 2012, September 261, 2012, October 29, 262, each of which was December 263, 2012, May 265, 2013, and June 26, 2013; and each of which was publicly offered with credit assessment options issued on July 26, 2013, July 17, 2013, and August 28, 2013.
The credit rating for Korean corporate assessment, Korean credit rating, and Age Credit Information Bank Co., Ltd. was BB from January 1, 2008 to December 7, 2012. From December 7, 2012, BB was demoted from June 14, 2013 to B (Korean credit rating), and from September 11, 2013, B (Korean corporate assessment, age credit information), and B (Korean credit rating) were reappointed.
(3) The F issued STB (short-term electronic bonds) on July 5, 2013, August 2, 2013, and August 12, 2013.
The credit assessment rating of the Korean Corporate Assessment and Age Credit Information FCP was B around June 30, 2010, and was demoted on December 26, 2012, and the credit assessment rating of the STB was B on April 22, 2013, and was B-B on September 11, 2013.
(4) On August 13, 2013, D issued STB of credit assessment rating B.
The credit assessment rating for Korean corporate assessment and age credit information DTSB was B until April 25, 2013, and April 30, 2013, but was demoted from September 11, 2013 to B-B.
