A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. At night, around 02:40 on February 26, 2015, the Defendant: (a) intruded into the hospitalization room of 1169, Dong-gu D Hospital No. 1, Dong-gu, Gwangju; and (b) stolen the victim E’s cell phone (three gallon road) in an amount equivalent to one million won at the market price of the victim’s possession, which was located in the sick room, and one cell phone (three gallon road road) located in the victim’s cell phone case; and (c) one Samsung Samsung-name card in the victim’s husband’s her husband’s son’s son.
2. Fraud;
A. On February 26, 2015, the Defendant, at around 03:07, purchased tobacco of KRW 22,500 at the market price in the “IE” operated by the victim H in Gwangju-dong-gu, Gwangju-gu, and, at around 22,500, deceiving the victim by suggesting the victim as if he was his card and settling KRW 22,500, as in paragraph (1). The Defendant was issued the said tobacco to the victim.
B. On February 26, 2015, the Defendant ordered “L” main points operated by the Victim K in the Dong-gu Seoul Special Metropolitan City on February 26, 2015, the Defendant, as stated in Paragraph 1, issued an order for an alcoholic beverage of an amount equivalent to KRW 942,00,00, and issued an order for an alcoholic beverage of KRW 942,00,00, under the name of F, which was stolen (payment of KRW 50,00) and Samsung Credit Card (payment of KRW 892,00), as one’s card, to present it to the victim as if he were his card, and thereby deceiving the victim to settle KRW 942,00,00, and the card titleholder is in accordance
The victim received a delivery of alcohol and algorith equivalent to KRW 942,00 from the victim.
C. On February 26, 2015, at around 13:10, the Defendant: (a) concluded that, prior to the second floor of the N Hospital located in the Dong-gu Gwangju-gu, Gwangju-gu, the O, who is an employee of the delivery business of the credit card of the Korean bank, would deliver to the O the victim P who applied for the issuance of the credit card of the Korean bank “on the face of an employee who works in the same manner as that of the employees,” and (b) received the said items from theO that contain the credit card in the name of the victim.
