Reasons
Punishment of the crime
1. Defendant B (Defendant A, B, C, D, and E) was sentenced to imprisonment with prison labor for a short term of two years and six months at the Seoul High Court on May 29, 2015 due to a violation of the Punishment of Violences, etc. Act (joint injury) at the Seoul High Court on April 21, 2017, and the execution of the sentence is terminated on April 21, 2017, and on April 10, 2019, was sentenced to six months of imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (joint assault) at the Incheon District Court on April 10, 2019, and the said judgment became final and conclusive on August 16, 2019.
At around 03:50 on February 2, 2019, Defendants and G jointly, on the street in front of the “I” located in Bupyeong-gu Incheon Bupyeong-gu, Incheon, for the reason that the victim K (Nam, 25 years of age) was taking a bath, Defendant A took a part of the victim’s head due to her hand less than the part of the victim’s head due to drinking, Defendant B took the back of the victim’s face due to drinking, Defendant B took the victim’s face, Defendant C took the part of the victim’s face due to drinking, Defendant C took the part of the victim’s face with the victim’s face, Defendant D took the victim’s face with her hand, and G goes beyond the floor of the victim’s face, and Defendant C took the victim’s face due to the need for treatment of the victim, and Defendant B took the victim’s injury to the victim’s face.
2. Defendant F (Defendant B, F) was sentenced to one year of imprisonment with prison labor for an injury, etc. at the Incheon District Court on November 29, 2017, and completed the execution of the sentence on May 30, 2018.
