Reasons
Punishment of the crime
The defendant is the actual manager of the NMedical Foundation O in Dongdaemun-gu Seoul Metropolitan Government, who employs at least 15 full-time workers and operates a medical business.
When a worker dies or retires, an employer of the 2017 Highest 1256 shall pay the worker wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred.
Nevertheless, the Defendant is working from July 2, 2009 to December 12, 2016 at the above workplace.
A total of 4,416,530 won of wages of retired workers P, 1,480,000 won in October 2016, and 1,633,30 won in November 2016, as shown in the list of crimes (1) in the attached Table of Crimes (1), did not pay 4,416,530 won in total within 14 days from the date of retirement, which is the date of occurrence of a cause for payment, without any agreement between the parties on extension of payment
An employer shall pay retirement allowances within 14 days from the date of retirement, unless otherwise agreed by the parties concerned about extension of the due date for payment.
Nevertheless, the Defendant is working from July 2, 2009 to December 12, 2016 at the above workplace.
12,042,320 won of retirement allowance of retired workers was not paid within 14 days from the date of retirement, which is the date of occurrence of the reasons for payment, without any agreement between the parties on the extension of the due date.
The defendant of "2017 Highest 2234" shall work at the relevant place of business from October 1, 2007 to September 13, 2016.
As of July 2016, wages of Q Q 1,50,000 won, wages of 2,200,000 won on August 2016, and wages of 90,000,000 won on September 2016, 2016, annual refund of 201,280 won on year-end year-end tax settlement in 2012, 90,600 won on retirement allowances of 18,94,780 won on retirement allowances of 23,836,660 won on retirement allowances of 2013, without any agreement between the parties on the extension of the due date.
