Reasons
The grounds of appeal are examined.
1. As a matter of principle, attorney fees that can be paid at the expense of an organization are limited to cases where the organization itself becomes a party to a lawsuit, the attorney fees for civil and criminal cases in which the representative of the organization becomes a party to the lawsuit cannot be
However, a substantial interest in the dispute is an organization, but for legal reasons, an individual who is in the status of the representative becomes a party to a lawsuit or other legal procedure.
(2) Where there is a special need to file a lawsuit or respond to a complaint for the interests of an organization in light of all the circumstances at the time, such legal disputes are deep related to the organization and there is a special need to do so as to pay the attorney fees at the expense of the organization, such as the case where a dispute arises in connection with the act of duties lawfully done for the organization or the status of its representative
(2) On October 11 and 17, 2011, the following facts are revealed by the aforementioned legal principles and evidence duly adopted by the court below and the court of first instance that the court below maintained by the court below (see, e.g., Supreme Court Decision 2004Do6280, Oct. 26, 2006).
