A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

In using and managing the means of access used in electronic financial transactions, no person shall transfer or acquire any means of access, or receive, request or promise any compensation therefor, unless otherwise expressly provided for in any other Act.

Around 13:00 on February 25, 2019, the Defendant issued a proposal to the effect that he/she will give a loan to a person with no personal name, “on the face of sending a physical card” from a person with no personal name, and that he/she will deliver a physical card connected to the bank account in the name of the Defendant for the purpose of obtaining a loan, to the Kwikset service provider who sent the above non-personal name to the above-mentioned person.

Accordingly, the defendant promised to receive a future loan in return for an intangible expected profit, and lent the means of access used in electronic financial transactions to others.
