Reasons
Punishment of the crime
From October 30, 2015, the Defendant is a personal constructor who takes charge of removal of the building B in North Korea-Gu from around the port to the port, and a business owner who exercises overall control over and manages matters concerning the safety and health of workers in the site.
1. A business owner in violation of the Industrial Safety and Health Act shall have workers wear safety belts at a place at a height of at least two meters likely to fall, install equipment, etc. to safely walk up inside, and, in the course of dismantling a building, etc., conduct a prior inspection of the details of the work, structure and surrounding conditions of the workplace, etc. in order to prevent workers' danger, and accordingly, conduct a subsequent inspection of the method of dismantling, drawing of order of dismantling, temporary installation, protection, ventilation equipment and fire prevention, communication methods within the place of business, plans for disposal of dismantled water, work plans for using powders, etc. for dismantling work, and work plans including other matters concerning safety and health;
Nevertheless, at around 16:00 on November 3, 2015, the Defendant did not prepare a work plan to prevent workers’ danger, and did not install a support unit, etc. to be used by having C workers belonging to the above removal work site work on the roof of 2.8 meters high risk of falling and sub-leaseed, and C lost its body balance while performing the above work on the roof, and left it on the floor, and then caused the death by thirst pressure, etc. at the German hospital specified for the port of 351 as at the south-gu Masco, South-gu, 2015.
2. On November 3, 2015, the Defendant: (a) around 16:00, at the site of the removal of the above “B” around November 3, 2015, carried out the cutting of the gel of sandbd position plates by using the female, who is a cutting device, on the roof of 2.8 meters high, with the victim C.
In such cases, the defendant falls down with the victim.
