Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

On May 12, 2016, the Defendant was sentenced to ten months of imprisonment by the Ulsan District Court for fraud, etc. and completed the term of imprisonment at the Port Correctional Institution on January 7, 2017 and has many criminal records of the same kind.

1. Habitual fraud;

A. On March 3, 2017, the Defendant: (a) at the “E” singing shop operated by the victim D at Jeju on March 19:30, 2017; (b) as if the Defendant did not have any intent or ability to pay the price, he did not pay the price by ordering the sum of KRW 150,000 in the market price of both the two weeks and Ansan, and did not pay it.

B. On March 14, 2017, the Defendant: (a) at the “H” restaurant operated by the victim G in the Jeju City F on March 14, 2017; and (b) as if the Defendant did not have any intent or ability to pay the price, he did not pay the price by ordering the amount equivalent to KRW 19,000 in total market price by the small and high school owners and the Gu, and did not pay the price.

On March 14, 2017, the Defendant, at around 17:00, obtained the amount of money from the victim J (K) restaurant operated by the victim J (J) on March 14, 2017, as if he did not have the intent or ability to pay the money, he did not pay the money by ordering the sum of KRW 14,00,000 in total and the market price of the so-called “beat and the bat bamboo.”

(d)

On March 16, 2017, the Defendant, at around 22:00, obtained the amount of money from the “N” entertainment center operated by the victim M in L on March 16, 2017, as if he did not have the intent or ability to pay the amount, he did not pay the said amount even if he did not pay the amount.

E. On March 17, 2017, the Defendant did not pay the amount equivalent to the same amount, even though (i) the Defendant received orders for the total amount of KRW 200,000,000 from the two weeks and the Ansan market price, even though he/she did not have any intent or ability to pay the amount, even though he/she did not receive orders from the victim P on March 17, 201.
