Reasons
1. The reasoning for the court's explanation of this case is that it is insufficient to admit the plaintiff's assertion as to the documents submission response of Gap's letter of evidence Nos. 32 through 37 and the F Hospital funeral of the court of the first instance, which are submitted additionally by the court of the first instance. The part of "B. Judgment" of the judgment of the court of the first instance is the same as the part of the reasoning of the judgment of the court of the first instance, and thus, it is citing it as it is in accordance with the main sentence of Article 4
【Supplementary Use】
B. In order to constitute a false de facto marriage, there is insufficient circumstance that there is a simple living together or a sporadic marital relationship between the parties. The parties should have a substance of marital life that can recognize marital life in terms of social order and social order.
(see, e.g., Supreme Court Decision 2000Da52943, Apr. 13, 2001). We examine the case, and evidence submitted by the Plaintiff alone that the Defendant and the Deceased engaged in a marital life corresponding to a de facto marriage.
It is insufficient to deem that the failure of the marriage between the plaintiff and the deceased caused the failure of the marriage by maintaining improper relations, such as the adultery, and there is no other evidence to acknowledge it.
2. In conclusion, the plaintiff's claim of this case should be dismissed as it is without merit. The judgment of the court of first instance is just in conclusion, and the plaintiff's appeal is dismissed. It is so decided as per Disposition.
