7. 20.경까지 용인시 수지구 C건물 202-4호에 있는 피고인의 집에서, 당시 동거생활을 하던 여자청소년인 D(여, 14세)로부터 조건만남(성매매를 말함)을 하여 생활비를 벌겠다는 제안을 듣자, 피고인이 소지하고 있던 공기계 휴대전화 및 D의 휴대전화를 무선인터넷망에 연결한 후 휴대전화에 설치되어 있던 ‘즐톡’, ‘티톡’ 등 메신저 프로그램에 “1시간 한번 20 키 162. 45A 18살 텔못감, 차에만 질사. 얼사. 후장. 입사. 노콘 빼고 가능”이라는 성매매 정보를 게시하여 불특정 다수에게 제공하고, 그 무렵 이를 보고 연락을 하여 온 성명불상의 남성을 D와 연결시켜 주는 방법으로 청소년의 성을 사는 행위를 알선하고 정보통신망에서 알선정보를 제공하였다.
